Personal data protection in accordance with the Organic Law on Personal Data Protection (LOPD, for its initials in Spanish)

Pursuant to the regulations in force regarding personal data protection, Adivin Beach Flag SA informs you that the personal data gathered through the forms on the Website (www.adivin.com) are incorporated into specific automated files for users of Adivin Beach Flag SA’s services.

The purpose of the collection and automated processing of personal data is to maintain the commercial relationship and to carry out tasks related to information, training, advising and other activities performed by Adivin Beach Flag SA.

  1. In the event of you contracting goods or services offered through www.adivin.com, to maintain the contractual relationship, as well as for the management, administration, information, provision and improvement of the service.
  2. To send information requested through the forms available on www.adivin.com.
  3. To send newsletters or commercial communications containing promotions and/or publicity regarding Adivin Beach Flag SA and the sector in general.

All the fields in these forms must be filled in, as it is impossible to carry out our stated purposes if these data are not provided.

How long are the personal data collected kept?

Unless you request their deletion, the personal data provided will be kept for as long as the commercial relationship is maintained, and for the period of time within which legal responsibilities may arise from the services provided.

Legitimacy:

The processing of your data is carried out based on the following legal grounds:

  1. A request for information from Adivin Beach Flag SA and/or contracting Adivin Beach Flag SA’s services, whose terms and conditions will always be made available to you prior to any potential contracting.

Data collected by users of the services

In cases where the user adds files containing personal data to the shared hosting servers, Adivin Beach Flag SA is not responsible for the user’s breach of the GDPR.

Data retention in conformity with the LSSI

Adivin Beach Flag SA informs you that, as a data hosting service provider and pursuant to the provisions of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI, for its initials in Spanish), it retains the information necessary to identify the origin of the hosted data and the time the service began for a maximum period of 12 months. The retention of these data does not affect the secrecy of communications, and they may only be used in the framework of a criminal investigation or to safeguard public security, being made available to judges, courts and/or to the Ministry, as required.

The communication of data to law enforcement forces and agencies shall be made in accordance with the provisions of regulations on personal data protection.

Intellectual property rights of Adivin Beach Flag SA

Adivin Beach Flag SA is the owner of all copyrights, intellectual and industrial property, “know-how”, and any other rights related to the contents of the website www.adivin.com and the services offered therein, as well as of the software necessary for their implementation and all related information.

Any reproduction, publication and/or use that is not strictly private of the contents of the website www.adivin.com, in full or in part, is prohibited without prior written consent.

Intellectual property of the software

The user must respect any third-party software put at his/her disposal by Adivin Beach Flag SA, even if the software is free and/or publicly available.

Adivin Beach Flag SA has the required exploitation and intellectual property rights regarding the software.

The user does not acquire any right or license through the contracted service regarding the software required to provide the service, nor regarding the service’s technical monitoring information, except for the rights and licenses necessary for the fulfilment of the contracted services and only during the duration of those services.

For any action that goes beyond the fulfilment of the agreement, the user will need written authorisation from Adivin Beach Flag SA. The user is prohibited from accessing, modifying or visualising the configuration, structure or files of the servers owned by Adivin Beach Flag SA, assuming the civil and criminal liability derived from any incident that could occur in the servers or security systems as a direct consequence of a negligent or malicious action by the user.

Intellectual property of the hosted content

Any use of the services provided by Adivin Beach Flag SA that is contrary to legislation on intellectual property is strictly prohibited, in particular:

  • Use that is contrary to Spanish laws or that infringes on third party rights.
  • The publication or transmission of any content that Adivin Beach Flag SA considers to be violent, obscene, abusive, illegal, racist, xenophobic or defamatory.
  • Cracks, program serial numbers, or any other content that infringes upon the intellectual property rights of third parties.
  • The collection and/or use of other users’ personal data without their express consent or in violation of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
  • The use of the domain’s mail server and email addresses for sending bulk spam mail.

The user is fully responsible for the content of his/her website, the information transmitted and stored, the hypertext links, any claims by third parties, and any legal actions regarding intellectual property, third party rights, or the protection of minors.

The user is responsible for the laws and regulations in force and for the rules relating to the operation of the online service, e-commerce, copyright, maintenance of public order, as well as the universal principles of Internet use.

The user shall compensate Adivin Beach Flag SA for any expenses generated by any charge brought against Adivin Beach Flag SA that is attributable to the user, including legal defence fees and expenses, even in the case of a non-definitive judicial decision.

Protection of hosted information

Adivin Beach Flag SA makes backups of the contents hosted on its servers; however, it is not responsible for the loss or accidental erasure of data by users. Likewise, it does not guarantee the total replacement of data deleted by users, since this data may have been deleted and/or modified during the period of time that has elapsed since the last backup.

The services offered, except backup-specific services, do not include the replacement of any content stored in the backups made by Adivin Beach Flag SA, when this loss is attributable to the user; in this case, a fee will be determined according to the complexity and volume of the recovery, following prior acceptance by the user in all cases.

The replacement of deleted data is only included in the price of the service when the loss of the content is due to causes attributable to Adivin Beach Flag SA.

Commercial communications

Pursuant to the LSSI, Adivin Beach Flag SA will not send advertising or promotional communications by email or any other equivalent electronic communication means that have not been previously requested or expressly authorised by the recipients.

In the case of users with whom there is a previous contractual relationship, Adivin Beach Flag SA is authorised to send commercial communications regarding Adivin Beach Flag SA products or services similar to those initially contracted by the customer.

The user, after verifying his/her identity, will at any time be able to request that no more commercial information be sent to him/her. This request can be made through the Customer Service channels.
